The New York State Health Insurance Program (NYSHIP) is the umbrella health insurance program for New York State public employees, retirees, and their dependents. The Empire Plan is NYSHIP’s primary health insurance option — and for the majority of enrollees, the two terms refer to the same coverage.

- Inpatient / Residential Rehab — 24/7 structured treatment in a licensed facility
- Partial Hospitalization (PHP) — intensive daytime treatment with evenings at home
- Intensive Outpatient (IOP) — structured outpatient treatment, often 3–5 days/week
- Outpatient Treatment — individual and group therapy for ongoing recovery
- Medication-Assisted Treatment (MAT) — Suboxone, methadone, or naltrexone for opioid addiction
- Dual Diagnosis Treatment — integrated care for co-occurring mental health and substance use disorders

NYSHIP and Empire Plan Coverage by Bargaining Unit
The Empire Plan covers state employees across multiple bargaining units, with addiction treatment benefits applying consistently to all enrolled members and their dependents:

Mental Health Parity and NYSHIP
Under the Mental Health Parity and Addiction Equity Act (MHPAEA), NYSHIP and the Empire Plan are required to cover addiction treatment on equal terms with medical and surgical benefits. This means addiction treatment cannot be subject to more restrictive visit limits, copays, or prior authorization requirements than physical health treatment under the same plan.
For most in-network outpatient addiction treatment under the Empire Plan, prior authorization is not required, allowing members to begin care quickly when they need it.

Confidentiality for New York State Employees Seeking Addiction Treatment
Many New York State employees hesitate to use their NYSHIP benefits for addiction treatment out of concern that their employer or agency will be notified. Under federal law (42 CFR Part 2) and HIPAA, substance use disorder treatment records are strictly confidential. Treatment providers cannot share information with an employer, supervisor, or family member without the patient’s written consent.
